IMPORTANT: These Terms govern use of the public BCX National website. They do not replace a signed customer agreement, carrier agreement, statement of work, rate confirmation, bill of lading, tariff, or other transaction-specific contract.
These Terms and Conditions ("Terms") are a binding agreement between you and BCX National. By accessing, browsing, submitting information through, or otherwise using the website and any related webpages, forms, content, or tools (collectively, the "Site"), you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.
If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" includes both you and that organization. If you do not agree to these Terms, do not use the Site.
The Site provides general information about BCX National, its capabilities, service areas, technology, logistics solutions, delivery and installation support, and related business services. Site content is for general informational purposes only.
A request for information, quote, consultation, capacity, service, employment, vendor enrollment, or partnership submitted through the Site is only an inquiry. It does not create a contract, guarantee availability, establish a carrier-broker relationship, reserve capacity, confirm pricing, or obligate BCX National to perform services. Services become binding only when the parties enter into a separate written agreement or BCX National issues written confirmation through an authorized representative.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site. You may use the Site only for lawful business or informational purposes and in compliance with these Terms and applicable law.
You are responsible for the accuracy, completeness, and legality of information you submit. You may not misrepresent your identity, authority, affiliation, shipment details, service needs, or any material fact.
You may not: (a) access or use the Site for unlawful, fraudulent, deceptive, or harmful purposes; (b) attempt to gain unauthorized access to the Site, its servers, accounts, networks, or data; (c) introduce malware, ransomware, viruses, or other harmful code; (d) interfere with Site performance or security; (e) scrape, harvest, crawl, index, copy, or extract Site content or data through automated means without our written permission; (f) reverse engineer or attempt to discover source code; (g) impersonate another person or entity; (h) submit confidential, regulated, or sensitive personal information unless BCX National specifically requests it through an approved process; or (i) use Site content to compete with BCX National or create a misleading impression of affiliation or endorsement.
We may restrict or terminate access, preserve evidence, and refer suspected unlawful activity to appropriate authorities.
Any rates, timelines, service descriptions, coverage maps, availability statements, performance examples, or estimates displayed or communicated through the Site are illustrative and nonbinding unless expressly incorporated into a signed agreement. Final pricing and service commitments may depend on shipment characteristics, origin and destination, site readiness, equipment, labor, access conditions, scheduling, regulatory requirements, customer instructions, and other operational factors.
You must independently verify information that is material to a shipment, installation, procurement, or business decision.
The Site and its content—including text, graphics, photographs, videos, designs, layouts, databases, software, trademarks, service marks, trade names, logos, and compilations—are owned by or licensed to BCX National and are protected by intellectual-property laws.
Subject to these Terms, BCX National grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your internal informational and legitimate business-evaluation purposes. No other right or license is granted. You may not reproduce, distribute, modify, publish, publicly display, sell, license, create derivative works from, or commercially exploit Site content without our prior written consent.
BCX National, BCX, and related names, logos, product names, service names, designs, and slogans are trademarks of BCX National or its affiliates or licensors. You may not use them without prior written permission.
If you submit an inquiry, document, proposal, feedback, suggestion, idea, or other material through the Site (a "Submission"), you represent that you have the right to provide it and that it does not infringe another party's rights or violate law.
You retain ownership of your Submission. You grant BCX National a nonexclusive, worldwide, royalty-free license to use, reproduce, transmit, store, and disclose it as reasonably necessary to respond to you, evaluate a potential business relationship, provide requested services, protect the Site, comply with law, and operate our business. Unsolicited suggestions may be used without restriction or compensation, provided we do not publicly identify you without permission. Do not send trade secrets or highly sensitive information through general Site forms.
Our collection and use of personal information through the Site are described in our Privacy Policy, which is incorporated into these Terms by reference. By providing contact information, you authorize BCX National to respond to your request by email, telephone, text message, or other reasonable means, subject to applicable law and any choices you make.
You are responsible for maintaining current contact information and for safeguarding any device or account used to communicate with us. Electronic communications may not always be secure or error-free.
Program description: By opting in, you agree to receive text messages from BCX National about your coverage inquiries, truck availability updates, and related service or shipment notifications.
Consent: Consent to receive text messages is not a condition of purchasing any service.
Message frequency: Message frequency varies based on your inquiries and service activity.
Costs: Message and data rates may apply. Check your mobile carrier plan for details.
Opt-out: You can cancel at any time by replying STOP. After you send STOP, we will send one message confirming that you have been unsubscribed, and you will receive no further text messages unless you opt in again.

Carrier liability: Mobile carriers are not liable for delayed or undelivered messages.
Privacy: Your SMS information is handled as described in our Privacy Policy. SMS opt-in data is not sold or shared with third parties for marketing purposes.
The Site may link to third-party websites, maps, social networks, software, platforms, or other services. Links are provided for convenience and do not imply endorsement. BCX National does not control and is not responsible for third-party content, availability, security, privacy practices, or terms. Your use of third-party services is governed by the third party's terms.
We may change, suspend, withdraw, restrict, or discontinue any part of the Site at any time without notice. We do not guarantee that the Site or any content will be available, uninterrupted, timely, secure, complete, accurate, or error-free. We may update these Terms by posting a revised version and updating the effective date. Changes apply prospectively when posted unless applicable law requires otherwise. Your continued use after posting constitutes acceptance of the revised Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BCX NATIONAL DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
BCX NATIONAL DOES NOT WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS; THAT ACCESS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BCX NATIONAL AND ITS AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OPPORTUNITY; BUSINESS INTERRUPTION; OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF BCX NATIONAL FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
You agree to defend, indemnify, and hold harmless BCX National and its affiliates, owners, directors, officers, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, awards, penalties, costs, and reasonable attorneys' fees arising from or related to: (a) your violation of these Terms or applicable law; (b) your misuse of the Site; (c) your Submission; or (d) your infringement or violation of another person's rights. BCX National may control the defense of any matter subject to indemnification, and you agree to cooperate.
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Subject to any mandatory law to the contrary, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia.
Before filing a claim, each party agrees to provide written notice describing the dispute and to allow at least 30 days for good-faith informal resolution.
If you believe content on the Site infringes your copyright, send a written notice to it.admin@bcxnational.com and 116 Agnes Road SW, Knoxville, TN 37919. The notice should identify the copyrighted work, identify the allegedly infringing material and its location, provide your contact information, include a good-faith statement that the use is not authorized, include a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and include your physical or electronic signature.
BCX National may remove or restrict access to challenged material and may terminate repeat infringers when appropriate. Nothing in this section designates an agent with the U.S. Copyright Office unless BCX National separately completes the required designation.
These Terms and the Privacy Policy constitute the entire agreement regarding use of the Site, but do not replace any separate written agreement governing services or another relationship with BCX National. If a separate signed agreement conflicts with these Terms concerning contracted services, the signed agreement controls for those services.
If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. BCX National's failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; BCX National may assign them in connection with a merger, reorganization, asset transfer, or by operation of law. Headings are for convenience only. Provisions that by their nature should survive will survive termination.
